Arden Land Partners – Terms for Builders (Land Search and Site Alerts)

"We", "us" means Arden Land Partners. "You" means the builder, developer or business named on the order. These terms apply to business customers only.
1. The services
Land Search (£199, one-off). We screen land in our council areas (Solihull, Warwick, Stratford-on-Avon, Bromsgrove, North Warwickshire, Lichfield, Rugby, Nuneaton & Bedworth) against a brief agreed with you in writing, and deliver a shortlist of plots with a site pack for each. Delivery within 5 working days of the later of payment and written agreement of the brief. We reply to messages within 1 working day.
Site Alerts (£29 a month). Weekly screening of new plots, planning decisions, garage sites and auction lots against your brief. Paid members receive matches before free-list members; free-list members receive matches 7 days later. Up to 5 site packs a month. A maximum of 3 paid builders per council area; further applicants join a waiting list.
Plot Check (£99 per plot). You send us a plot you have found. Within 3 working days of confirming the order we send a one-page site pack covering boundary, Green Belt, flood zones, planning and appeal history, local plan, nearby approvals and comparable prices.
Owner Letter Campaign (£149 per plot, plus postage and any Land Registry title at cost). After you sign our Introducer and Non-Circumvention Agreement, we draft and post a letter to the registered owner on your behalf and forward any replies to you.
2. Fees and payment
- Land Search: £199 payable in advance, after the brief, price and delivery date are confirmed in writing.
- Site Alerts: payable monthly in advance.
- Land Registry title copies: about £7 each, charged at cost, bought only with your prior OK.
- VAT not charged. Prices shown are the full amount payable.
2A. Plot Check and Owner Letter Campaign
- Plot Check: if we do not deliver the site pack within 3 working days of confirming your order, we refund the £99 in full.
- Owner Letter Campaign: we cannot guarantee that an owner replies or agrees to sell. Postage and any Land Registry title are charged at cost, titles only with your OK. Owner details from the title are used only to send that letter, under UK GDPR (ICO registration ZC273753).
3. Refund guarantee (Land Search)
If fewer than 3 plots match the agreed brief, we refund the £199 in full. "Match" means a plot that meets the written brief and passes our screening filters. Title costs you approved are not refundable.
4. Finder's fee
- If you, or a connected party, buy, lease long-term or otherwise acquire an interest in a plot we introduced, you pay a finder's fee of 2% of the purchase price, minimum £1,500.
- Due on completion. If you secure the plot by option, promotion agreement or conditional contract, the fee is payable when that agreement is signed.
- Any Land Search fee you paid for the brief that produced the introduction (£199) is credited against the finder's fee.
- "Connected party" includes any company, partnership, director, shareholder, employee, family member, joint-venture partner, funder or nominee connected with you or acting for you.
- An "introduction" is any plot, owner identity or site detail we give you that you could not show you already knew, in writing, before we gave it to you.
5. Confidentiality and non-circumvention (24 months)
Site details and owner details are shared only after you sign our Introducer and Non-Circumvention Agreement. For 24 months from each introduction you must not contact the owner, or deal for the plot, except through us or with our written consent, and must not pass details to anyone else. If you do, the finder's fee in section 4 is still payable.
6. Disclosure to landowners
We disclose to landowners that we receive fees from builders, and the amount or basis of those fees. Paying for Site Alerts or a Land Search does not buy exclusive rights to any landowner or plot, and does not change anything we owe the landowner.
7. General information only – no advice
Site packs and alerts are general information compiled from public sources, with each source named. They are not legal, planning, valuation, survey or investment advice. We do not guarantee that a plot is for sale, that planning will be granted, or that any data is complete or current. You should take your own professional advice before acting. We do not advise on bidding at auction.
8. Late payment
Unpaid sums carry statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998 from the due date.
9. Cancellation
- Site Alerts is month to month. Cancel any time by email to [email protected]; it stops at the end of the paid month. No cancellation fee.
- Land Search: you may cancel before we start work for a full refund. Once work has started, the refund guarantee in section 3 applies.
- Cancelling does not end sections 4 and 5 for introductions already made.
10. Data protection
We are registered with the Information Commissioner's Office (ZC273753). We use your details to deliver the services, invoice you and keep records required by law, including anti-money-laundering checks. Owner details obtained from HM Land Registry are used only for the introduction they relate to. Our privacy notice is at ardenlandpartners.co.uk/privacy. You must handle any owner personal data we give you lawfully and only for the plot concerned.
11. Anti-money-laundering
We may need to verify your identity and that of your business before we act.
12. Liability
Our total liability under these terms is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect loss or lost profits. Nothing limits liability that cannot be limited by law.
13. General
English law; courts of England and Wales. These terms, the confirmed brief and the signed Introducer Agreement are the whole agreement.
